These Event Hire Terms and Conditions (the "Terms") are entered into by and between the customer (referred to as "Hirer" "You," or "Your") and La Simplicitè (referred to as the "Company," "We," "Us," or "Our"), a South Australian-based business, collectively referred to as the "Parties." These Terms outline the terms and conditions governing the rental of event equipment and services provided by the Company.
Booking and Conrmation
A booking is considered conrmed when the Company receives a signed booking agreement and any required deposits or payments.
All bookings require a 30% deposit to be paid within seven (7) days of quotation issued. Bookings are not conrmed until the deposit has been received.
An additional security bond will be required in addition to the deposit. Security bond will be refunded after the hire; less any incidentals or damage.
The Company is under no obligation to proceed with the hire if the deposit and/or full payment has not received.
Upon payment of the deposit the Customer will have been deemed to have accepted the Terms and Conditions of Hire.
Payment
Payment for the event hire services must be made as per the invoice provided by the Company. Payment to be made in the way of bank transfer.
A deposit of 30% is required to secure the booking and will be deducted from the total invoice amount.
The Hirer must pay the balance of the Total Fees to the Company at least fourteen (14) days prior to the scheduled delivery/collection of the Equipment.
Changes & Cancellation
Any changes or cancellations of the booking must be communicated to the Company in writing and are subject to availability.
Cancellations made less than twenty one (21) days prior to the event result in a fee of 50% of the total rental fees, as specied in the terms and conditions.
Cancellations made less than seven (7) days prior to the event will result in a fee of 100% of the total rental fees, as specied in the terms and conditions.
Equipment and Services
The Customer is responsible for inspecting all equipment upon delivery and must report any damages or issues to the Company immediately.
The Customer agrees to use the equipment solely for its intended purpose and in accordance with any provided instructions.
The Customer is responsible for any loss, damage, or theft of the equipment during the rental period. Replacement or repair costs will be charged to the Customer.
The Customer acknowledges that they are liable for any loss or damage to the Equipment from the time of delivery until it is returned to or picked up by the Owner.
The equipment must be returned to the Company in the same condition as when it was received, normal wear and tear excepted, by the agreed-upon return date and time.
Delivery and Collection
Delivery, collection and/or return of the Equipment is at the Hirer’s expense and is not included in the hire cost.
The Hirer will be required to show a valid form of photo identication (drivers license or passport) in which a copy will be taken for security measures.
The Company will deliver the equipment at the agreed-upon location and time. Any changes to the delivery address or time must be communicated in advance.
The agreed-upon delivery location should be easy to access, with no obstruction and on ground level only. Extra charges on top of the usual delivery charge apply where the delivery of the Equipment is more than 10 metres away from where our vehicle can park, is up .
The Company is not responsible for the set-up of the Equipment once it has been delivered unless an agreement in writing has been made between the Hirer and the Owner. Any additional labour that is required for set-up or pack down of Equipment that has not been agreed to in writing between the Hirer and Owner, is subject to additional fees at the discretion of the Owner.
Return
All Equipment comprising of crockery, cutlery and glassware must be rinsed, cleaned (with all food matter removed) and dried before being returned to the Owner. If crockery, cutlery or glassware is not returned in a clean condition (as determined by the Owner in its absolute discretion), the Hirer will be charged and agrees to pay the Owner a cleaning fee of $0.25 per item.
If any Equipment is returned not in accordance with the terms and conditions, the Hirer agrees and acknowledges that they will be responsible for any loss or damage to Equipment.
Liability and Insurance
The Company shall not be liable for any injury, loss, or damage arising from the use of the rented equipment, except in cases of gross negligence.
The Customer is encouraged to obtain suitable insurance to cover any unforeseen circumstances or losses related to the event.
Force Majeure
Neither party shall be liable for any failure or delay in performing its obligations under these Terms due to events beyond its reasonable control, including but not limited to acts of God, natural disasters, strikes, or government actions.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of South Australia, and any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the South Australian courts.
Entire Agreement
These Terms constitute the entire agreement between the Parties concerning the subject matter hereof and supersede all prior and contemporaneous agreements and understandings, whether oral or written.
By signing below, the Customer acknowledges that they have read, understood, and agreed to these Event Hire Terms and Conditions.
